How to explain incarceration?
Know Your Rights - There is no better weapon than knowing what you are entitled to. Sure, you made a mistake and now have a criminal record, but this doesn’t mean that employers can deny employment when you are clearly qualified for the job. The justice system has come a long way in helping individuals with records.
Each state has a different set of rules, so be sure to do proper research.
Be Honest - If you live in one of the states that allow checks, leave the subject until you are much closer to getting the job. Conducting a background check isn't always a requirement to procure a job. If you've seen in the job description that it's part of getting hired, consider addressing the results near the end of your interview (it's not suggested for a first conversation).
We recommend discussing the background check after you've been offered the position and just before accepting it. By that point, they are more invested and you don't risk getting accused of lying after getting hired.
The key is to be able to speak on how you have developed as a person.
Provide a simple statement, "I was young, and made the mistake of trusting someone I shouldn't have. I've paid for my mishap and grown tremendously. I'm excited about the opportunity to do x, y, and z with your company".
You can let them know that you stumbled down a bad path in your younger years, but you've completed your time, moved forward and now "this opportunity" at "this company" is the perfect fit for your skills. Remind them why this job appealed to you and how that means you'll be infinitely dedicated to excelling in the role.
The goal is to eliminate any possible fear that you may be a risk once hired.
Additionally, there are many organizations (mostly non-profits) specifically committed to finding employers who hire and value the skills of those who have felony records. Reach out to your local establishments to see if anyone can assist in locating job opportunities that would look past your record and appreciate your accomplishments.
